A prosecutor with the Office of the U.S. Attorney for D.C. and a defense attorney filed a joint motion in federal court on Jan.
8 asking a judge to postpone a preliminary hearing for gay D.C. gym owner Michael Everts, who was arrested Nov. 29 on a charge of distributing child pornography.
The joint motion, which was approved, discloses that prosecutors plan to issue a plea offer to Everts for which he could plead guilty to a possible lesser charge and the two sides need more time to discuss the plea bargain offer. “At this time the parties are working diligently to determine whether this case can be resolved short of trial and asks that the court continue the preliminary hearing to allow time for both a fulsome review of discovery, as well as time for the defense to make an informed decision on the anticipated forthcoming plea offer,” the motion states.
The term discovery refers to the requirement that prosecutors provide the defense attorney with evidence obtained by police and prosecutors that would be used against a defendant at a trial.
